Texas Rideshare Driver Requirements

While rideshare drivers have the same duty to abide by the laws of the road, the State of Texas passed specific requirements for drivers. These include:

  • Rideshare drivers must be at least 18 years old
  • Rideshare drivers must have a valid driver’s license from any state in the US
  • Rideshare drivers must have proof of registration and insurance for the vehicle that they use
  • Texas law requires rideshare companies to perform a criminal background check before contracting a driver and every year the driver works
  • Texas law prohibits rideshare companies from hiring drivers with three or more moving violations, if they’ve fled law enforcement, if they have reckless driving charges, or if they’ve driven without a license
  • Texas law also prevents rideshare drivers from working in that capacity if they’ve had a DUI/DWI, committed a felony with the vehicle, committed a felony with property damage, engaged in fraud or theft, were involved in an act of terrorism or violence, or was convicted of a sex crime that requires registration as a sex offender

Common Rideshare Accidents in San Antonio

Rideshare accidents, including a Lyft accident and an Uber accident, commonly happen because:

  • Drivers aren’t properly trained
  • There’s a defective part on their vehicle
  • The driver was distracted, including texting and driving
  • The driver was speeding
  • The driver assaults the passenger
  • The driver was under the influence
  • The driver is fatigued

These aren’t the only reasons that ridesharing accidents happen in San Antonio and the surrounding cities in Texas. Accident victims experience injuries due wide range of causes.

Who Is at Fault in a San Antonio Rideshare Accident?

When you’re hurt in a rideshare accident, who’s at fault? The answer is that liability for rideshare accidents can be very tricky. Drivers must carry special insurance. Depending on the facts, the driver may be held liable through their insurance.

But what about the rideshare company? Rideshare companies do have liability insurance policies to pay the claims of injured victims. Yet, they often bat the claim back to the driver’s insurance. They may also do everything they can to minimize the injury claim. Simply put, while they may very well be liable, they’ll do everything they can to get out of properly paying a claim for injuries or property damage. That is why speaking with a San Antonio Uber/Lyft accident lawyer is crucial.
