5 Steps You Should Take After a Truck Accident

Posted By Aguirre Law | July 31 2023 | Firm News

If you are ever the victim of a truck accident, an experienced truck accident attorney can help you recover compensation for your property damage, medical expenses, and psychological trauma. However, the moments immediately following a truck accident can be confusing, emotionally overwhelming, and leave you unsure of what steps to take.

The following article outlines what to do in the event of a serious truck accident. Taking these measures can preserve your legal rights as well as protect your physical health.

Step #1: Remain Calm and Call for Assistance

It is important to stay calm and call for medical and police assistance after any truck accident. Panicking could further endanger your safety or that of anyone around you.

The police will conduct interviews and make observations about the accident scene in a police report. You will need to get a copy of the police report later when it becomes available. Never admit fault or apologize when speaking to the police.

You will also need to receive medical care whether or not you feel hurt. Many serious injuries are not apparent to the naked eye. This includes concussions and internal bleeding and organ damage.

Step #2: Document the Accident Scene (if Possible)

If you are physically able or have another person with you who is able, do the following to gather information and document the accident scene:

  • Exchange insurance and driver’s license information with the other drivers;
  • Get any eyewitness contact information;
  • Ask the responding officer for their name, badge number, and the police report number; and
  • Take photos of the accident scene, skid marks, vehicle damage, and injuries.

As soon as you can write down how the accident happened and any details you can recall.

Step #3: Go to the Doctor for Follow-Up Care

Follow up on any emergency care with your doctor or recommended specialists. Part of recovering for your accident losses is proving that those losses exist. You will need medical documentation that you sought treatment for your injuries.

It is also imperative that you secure timely medical care so there is no argument that you allowed a medical condition to worsen by not getting treatment.

Step #4: Do Not Talk to A Claims Adjuster

Do not talk to a claims adjuster until you speak with a personal injury attorney. Anything you say to a trucking company or truck driver’s insurance company can be used against you at a later date.

Be polite if you are called, but tell them that you will provide them with a written accident statement after speaking with an attorney.

Step #5: Contact an Experienced San Antonio Truck Accident Attorney

An experienced San Antonio truck accident attorney can handle all of your insurance company correspondence and work with you to ensure you receive a fair and just settlement for your accident-related losses. Always speak with an attorney before talking to any insurance adjuster to learn your legal rights as a truck accident victim.
